Asad Jmal – a human rights lawyer and legal researcher based in Lahore , Pakistan. He is our companion in the struggle for the protection of human rights of the marginalized section in Pakistan. His current research “FATA Between Constitutional Ambiguity and Violation of human rights: A Study for reform” is a much valuable work. In this study Mr. Asad highlighted those sections of frontier crime regulation and Article 247 of the constitution of Pakistan that are conflicting with human right law. He also added an account about the historical background of FCR and article 247 and termed that that law is a clear violation of human rights. He also provided a good comparison of International human rights law and article 247. For example, about sub article 1 he mentioned how this constitutional clause violates the rights under article 25 of International Convention Civil and political rights (ICCPR). So it is a very useful and interesting study.
During the inaugural ceremony of the report held in Islamabad, Senator Farhatullah Babar who has also moved a private member constitutional amendment bill to delate article 247 said under Article 247(7), the Supreme Court and high courts could not make recommendations for Fata. “There are no rules to protect the rights of the people of Fata, even elected members from the areas never raised their voice for the tribals,” he added. Mr. Babar appreciated Mr. Asad Jamal’s work and suggested for further study and research on the topic. Mr. Jamal also teaches criminal law, and has previously authored "Police organizations in Pakistan-Revising police laws".
The current research report is published by Center for Governance and public accountability (SGPA). SGPA is not for profit, civil society organization and strives for inclusive development and promotion of peace though right based and governance focused approaches.
