Ripple winning battles for the honor of XRP

in #busy6 years ago

Ripple has had legal problems throughout the year, being sued on multiple occasions, however, this does not stop the company that seeks to create a titan. Ripple's efforts to consolidate multiple lawsuits against it are being carried out successfully.

Ripple has been sued by several parties, which allege that the XRP token is used to feed some of their products as a guarantee, has been pushing for the various class action lawsuits to be combined, or at least coordinated, against them. Limit the number of cases you fight at once.

On Wednesday, a California Superior Court lawsuit filed by investor David Oconer was formally designated as " complex litigation ," which means it will now coordinate with the remaining lawsuits.

According to public documents, this follows another case from California, presented by investor Vladi Zakinov, which was already considered complex as of June 2018.

Under the rules of the California court, one of the requirements for a complex designation is that a case involves " claims of securities or investment losses involving many parties ." With the new designation, a single judge must supervise the actions related to the case to avoid duplicated efforts and potentially different results due to different cases.

However, one of the results of Oconer's action is that now the case is assigned to Judge Marie Weiner, who successfully moved to disqualify to preside over Zakinov's case. It is not clear if Ripple will move again for the judge to be disqualified from the new precedent.

Ripple has managed to coordinate the demands of Zakinov and Oconer earlier this month, claiming that the two class actions refer to "all or a material part of the same matter" and involve "all or substantially all of the same parts."

Another related class action lawsuit, filed by investor Ryan Coffey, was voluntarily dismissed by the investor last week. That case was transferred to the District Court of the Northern District of California by Ripple, although Coffey tried to return it to a lower court. His voluntary dismissal occurs after that effort was rejected.
