A DECENTRALISED MEANS OF RESOLVING CONFLICT BETWEEN PEOPLE THOUSAND MILES APART
INTRODUCTION:
According to Cambridge Dictionary, Disputes means an argument or disagreement, especially an official one between, for example, workers and employers or two countries with a common border
Disputes are inevitable and with our daily interaction and encounter with people from all walks of life, we are bound to encounter it. Dispute in the global, digital, and decentralised economy occur in areas where they cannot be solved by state courts and existing dispute resolution methods.
WHAT KLEROS BASICALLY DOES
KLEROS is a dispute resolution system that renders ultimate judgements in a fast, inexpensive, reliable and decentralized manner.
KLEROSIt is an Ethereum autonomous organization that works as a decentralized third party to arbitrate and help connect users who need to resolve disputes with jurors who have the skills to fairly settle the parties amicably without being biased.
Our resolution layer uses blockchain technology and crowd sourced jurors to adjudicate disputes in a fast, secure, and affordable manner.
The build up of Kleros stems from the onus of the world where we live in is experiencing an accelerated pace of globalization and digitalization and there's been heightened number of transaction being carried out online by people from different part of the world.
With the way things are turning out, soon most goods, labour and many other things will now be carried online through the decentralised platform and of course dispute will definitely show it's ugly head.
Just imagine when users decentralised Amazon will claim that the sellers failed to bring their good as promised in the agreement or when a product ordered is of poor quality and in order to remain the decentralised world to resolve the said dispute, some smart contract is made to serve as arbiter to the different party acting as the mediator between the parties in bid to resolve the said dispute.
Before now, the already existing dispute resolution technologies are too slow, way too expensive and too unreliable for a decentralized global economy operating in real time. KLEROS: is fast, inexpensive, transparent, reliable and decentralized dispute resolution mechanism that renders ultimate judgments about the enforceability of smart contracts is a key institution for the blockchain era.
KLEROS 4 EASY STEPS
Kleros is a decision protocol for a multipurpose court system able to solve every kind of dispute and it works with these 4 easy steps:
CONTRACT: Users create a smart contract and choose Kleros as its adjudication protocol.
DISPUTE: The relevant information is securely sent to Kleros.
SELECTION: A tribunal is drawn from the crowd. Jurors evaluate evidence and cast their vote.
ENFORCEMENT: The decision is enforced by the smart contract.
KLEROS RESOLVES BOTH DISPUTE FROM COMPLEX TO SIMPLE DISPUTES
Disputes in every kind of contract is being resolved from very simple to highly complex ones. Every step of the arbitration process is fully automated.
Another good part of Kleros is that it does not rely on the honesty of a few individuals but on game-theoretical economic incentives.
It is based on a fundamental legal epistemology where a court is an epistemic engine, a tool for identifying the truth about events from a confusing array of clues. A Jury follows an identified procedure where an evidence is used to make the final decision.
KLEROS: USE CASE
Ade is a Nigerian based entrepreneur/supplier who bought Makeup items from Amazon which is thousand miles away from Nigeria and Ade quickly made payments but when the goods arrived, it wasn't the specification of the goods ordered and Ade requested for a redress and Amazon was not paying any attention to Ade's complaint.
Out of frustration, Ade opted for Kleros court where Ade forwards an e-mail to Amazon asking them to "send to kleros" and a simple form was filled explaining Ade's claim.
Thousands of miles away, in Paris, Gustov is a software developer in his sitting room checking Kleros website to find some arbitration work. She makes a couple thousand dollars quarterly on the side of her primary job by serving as a juror in software development disputes between freelancers and their clients. She usually rules cases in the Website Quality sub-court.
This court requires skills in html, javascript and web design to solve disputes between freelancers and their customers. Gustov deposits 2 pinakion, the token used by Kleros to select jurors for disputes. The more tokens She deposits, the more likely is that She will be selected as juror.
About an hour later, an email hits Gustov's inbox: “You have been selected as a juror on a website quality dispute. Download the evidence here. You have three days to submit your decision”.
Similar email are received by James, a programmer from Costa Rica and Adamu, from Nairobi, who had also activated their pinakion for the dispute.
They were selected randomly from a pool of many candidates. They will never know each other, but they will collaborate to settle the dispute between Ade and Amazon. While in the office, Gustov analyzes the evidence and equally votes who is right.
48 hours later, after the three juries have voted, Ade and Amazon receive an email: “The jury has ruled for Ade.
The goods was not delivered in accordance to the specification agreed by the parties. A smart contract has demanded Ade request be attended to with immediate effect by Amazon”. Jurors are rewarded for their work and the case is closed.
