Reading the posts of the teaching team, in this case, @anasuleidy, made me so happy to start studying and doing the homework given. This theme is part of the learning materials I teach in school, especially in Citizenship Education subjects that are taught at the elementary school where I teach. We are talking about the basic understanding of Law, and this is quite interesting.


What I understand and explain to my students at school, is that the basic understanding of law is the subject-the subject of law which contains a set of rules or policies, and is used as a reference in making decisions, commonly referred to as the law.

The point of the law is divided into two, and I hope that what I have mentioned is not mistaken.

  1. Laws are written, they are codified (drafting) and not codified.
  2. Unwritten law, this is often also referred to as customary law. This law is more towards the norm, although it is still different from the norm.

In Indonesia where I live and grew up as a citizen, the law is classified based on the source. Some of these sources include :

  1. Derived from statutory law, a set of legal regulations contained in state legislation and binding.
  2. Sourced from customary law or called customary law, in this law, there are collections of norms that apply and develop in society.
  3. Derived from treaty law which is the regulatory law established by the participating countries of international agreements. Or an agreement governing relations between countries.
  4. It is the law of the land, the law of the land, the law of the land, the law of the land, the law of the land, the law of the land.

Now let's start to discuss the homework that has been given, I hope the preface above can lead me to the desired answer. Here is my homework explanation.


Case study part one :

From this first case, I tried to answer according to the rule of law in my country and analyze it. In this case, there are two conflicts of interest, the first is the interest of compliance with traffic rules, and the second is personal interests or human rights.

The part in which there is an objective right in this first case lies with the traffic police officer who has the right to dismiss the motorist. It refers to a set of laws that have been in force in a country, regardless of a particular class, and not based on any personal views.

While the subjective part of Rights lies in personal interests or human rights. Because in essence, the right to be a subjective part to get help, convenience, and exceptions to get protection.


Case study part two :

In this second case, involving Mr. Juan Perez, We must first interpret the laws and rules, are they the same?

I try to answer as I understand the question above. In principle, laws and rules are not the same, however, laws and rules are related to each other so that they have the same purpose, namely as a way of creating order and security in public life.

Not paying rent for 3 months and also keeping 4 dogs in his apartment, in some countries may be both a violation of the law and a clear violation of legal sanctions. But if you look deeper, then not paying rent in accordance with an official agreement based on legal approval, then the part not paying rent for 3 months is clearly in violation of the law.

And the part of keeping animals in his apartment is part of violating the rules that apply in his apartment. This is based on the general situation that occurs in many countries, something that disturbs the environment is always mostly hit with rules or regulations.


The task of the third part

Comparative law or in simple terms called comparative law, is very important to be understood well. It aims to understand more about what is meant by law, what is meant by norms, and what is meant by rules. So indirectly, we can understand well about the legal system itself.

Even by understanding Comparative Law or comparative law, we can learn and know about all the legal systems that exist in the world inclusively or openly with the rules and laws of other countries. Such as the theme of the teaching team in this first week, where we can read and compare participants ' homework from a view of the law in their country.

By answering all the assignments that have been given, I have shared my views on this week's theme based on the class material that I have read before. And I hope what I write can be accepted and understood well so that this can be a lesson for me on the themes of the next contest.
