that I'm gonna treat the Scopes of Labour Law one after the other. Today I would be explicating the 'Formation of Contract of Employment'. In the course of doing this I will try my best to avoid using legal terms and explain it in a lay man's understanding. So... I won't be citing cases and sections.😁 A relief right?😍🤣

MEANING OF CONTRACT OF EMPLOYMENT
A Contract of Employment refers to an oral or written agreement whereby a person called the employer agrees to employ the services of another called a worker who in turn agrees to work for him.
Here an employer and a worker agrees to work together based on certain conditions which include 'payment of salary' on the part of the employer and 'working' on the part of the worker.

However, before a valid contract could be formed, there must be the presence of these 4 elements thus:
~Offer
~Acceptance
~Consideration
~Intention to create Legal Relationship
I will briefly explain these 4 elements one after the other.

  1. OFFER
    An offer simply means a proposal made by a person to another of his willingness and readiness to enter into a contract with that other person based on certain conditions.
    The person who makes the offer is called the 'offeror' while the person whom It's made to is called the 'offeree'.

  2. ACCEPTANCE
    Acceptance of an offer is an expression made by the offeree which indicates his agreement with the offer made by the offeror.
    (Don't be confused, read it again.😁)
    It is simply an agreement to the proposal made by the offeror together with the said conditions.

  3. CONSIDERATION
    Consideration refers to the benefits, rights, losses or detriment suffered by one of the parties (offeror and offered) to a contract.
    It refers to the gains or losses either of the party would get from the contract.

  4. INTENTION TO CREATE LEGAL RELATION
    We say that there's intention to create Legal relation if such contract could be enforced by the law. If there's no intention to create Legal relation, it means that the contract can not be backed up by law especially if there is non performance by either of the parties.
    However, parties must decide if they want their contract to be enforceable by the law.

The above listed elements are very important when it comes to the formation of a valid contract of employment or anyother contract at all .
