Hello All, I am quite happy to be able to participate in learning again in this third week. Thanks to @anasuleidy and @elider11 for raising a very good friend to learn from, hopefully in line with expectations.

Speaking of human rights as far as I'm concerned, it has the same explanation and understanding. However, it should be noted that implementing human rights in each country is sometimes different. Not without cause and reason, this is influenced by the factor of the law in the country itself. I take an example in Indonesia, one of which is the rule of law regarding sexual minorities. In this case, I believe we are different in implementation regarding it.

Well, the brief explanation above is a preface for me to do the assignment according to this week's learning, and I hope what is conveyed is by the expectations of the teachers.


Part I
In accordance with what was explained in class, tell in your own words and explanations if you consider that human rights are respected or violated in your country.

By the definition of Human Rights, which are the inherent rights of human beings, each person and the state need to respect these individual rights. This is because human rights are a unity of the human individual, who is entitled to the rights of the individual and cannot be separated and must be respected.

The rights inherent in human beings must be respected and appreciated, this of course must be able to know its characteristics. What are the features of rights inherent in man :

  • Human rights are universal, meaning that these rights are owned by anyone, anywhere regardless of an individual's nationality, race, gender, and regardless of social status, even in actual circumstances not subject to specific laws in a country. This is what we call universal human rights.

  • Human rights cannot be taken away. This means that this right is specific to all individuals, it cannot be taken away from the individual, because the principle of human rights that falls into this category is a right that remains within the individual himself.

  • Human rights are interdependent. That is, all the rights inherent in human individuals are interrelated, the occurrence of violations of these human rights will be able to affect the rights of other individuals

  • Human rights are inviolable and progressive. That is, in any violation of the right no authority can ignore the right because it has been recognized throughout the world. In addition, human rights can be adjusted to the current human reality, and cannot be returned to the rights that have been recognized.


After knowing these characteristics, we already understand the basics of human rights. And it is important for us to respect and respect all forms of these human rights because they apply in all corners of the world. Although we must admit, there are some countries that do have restrictions and rules that limit these rights.


Tell us according to the laws of your country if human rights rank the same in value as your country's Constitution, if they are supra-constitutional, or if the Constitution prevails over international human rights treaties.

In Indonesia right where I grew up and live as a citizen, the law and human rights are actually aligned and balanced, if formally reviewed and universally recognized. But the bottom line is, sometimes some things in terms of implementation are still a challenge because some of the freedoms clash with the country's Constitution.

For example, as I mentioned at the beginning, the Basic Law of the country recognizes only two sexes as gender differentiators, namely men and women. Then the right of individuals to change themselves according to their wishes contradicts the basic foundations of the state. This is an example where there is freedom that must be straightened out, in accordance with the rights of the individual without violating the rules of the state.

Part II
I mentioned agencies in your area that have competence in the field of human rights. In your judgment, say how useful it is and how its operation affects respect for Human Rights in your country.

As one of the largest countries with a very large population, Indonesia is also a country that upholds the values of freedom as a form of tolerance in terms of human rights, but also still limits each individual to follow all the rights inherent in them.

Because of the importance of human rights in Indonesia, there is a state agency that takes care of and continues to monitor all types of human rights violations and also human rights itself. There are even institutions outside the government that also concentrate on human rights. Examples are :

  • The National Human Rights Commission is an independent state institution equivalent to state institutions, this national commission focuses on conducting studies, conducting research, conducting counseling, monitoring, and conducting human rights mediation. Have you or someone close to you ever been a victim of human rights violations, if so what is the situation and can you claim your rights?

Personally, my family and I have never experienced any human rights violations, and so far we have been able to maintain these human values.

However, human rights violations have also occurred frequently and continue to occur with different types of human rights violations. Of course, as a country that has a state legal basis that maintains freedom and Human Rights, all legal processes are running well. However, violations of human rights are severe, and sometimes also experience obstacles caused by the influence of the authorities, and also the circumstances to drag on in terms of settlement.


Part III

Practical case 1.

A woman lost her son because she died at the hands of several attackers who took her life to steal her car. The attackers soon after found out and were prosecuted for the murder. He is currently serving the sentence provided for in the law. However, the woman considered that her right to life had been violated and decided to file a complaint with the Inter-American Commission on human rights. Do you say Do you consider that the human rights of women and victims in such cases are indeed violated and whether the complaint to the body should be accepted or not. Based on their answers.

From the cases we have read together, eliminating the life of another person intentionally or unintentionally will be contrary to the laws in force in a country. Plus, it happens that a criminal act occurs, that is, taking someone else's property by force, this will certainly lead to punishment with layered charges.

From the victim's session, in this case, the woman, can file a complaint with the Inter-American Commission on Human Rights, or release all legal processes that she is experiencing to the applicable law, and I make sure that it will be processed with the rules and demands.

But if in the process there is no fair enforcement of the law because it has taken the life of another person, then a complaint to the Inter-American Commission on Human Rights can be the first option, in the hope that the actions of the perpetrator who caused the loss of the life of another person can be processed by universal human rights.


Practical case 2.

A man has been arrested amid anti-government protests. He received a blow from a police officer that led to his death. The prosecutor assigned to the case initiated the investigation without being able to accurately identify the perpetrators of this murder. Several years passed and the victim's relatives turned to the prosecutor's office for answers and there they told him that the case was closed because several years passed without being able to identify the official who caused the death. Tell us if you think the victim and his relatives violated his human rights. On the basis of the answer.

Cases like this are most cases that occur in almost all corners of the world, and from the story above it is clear that this is an act of violating human rights that is quite serious, because it is allegedly carried out by officers and stakeholders through directives or the like.

Termination of the case or not continuing the court proceedings on the case clearly violates human rights. Moreover, in these events, without any evidence what else in deliberately eliminating the lives of others clearly violates the law, let alone human rights.

Based on the experience that has happened, cases like this will be a little complicated and protracted to resolve. Such gross violations involve unscrupulous rulers who sometimes forget about human rights in their interests.
