Assalamu Alaikum friends. Wishing everyone good health. Hope you all are well. By God's grace I am fine too. Today I am here to participate in a wonderful learning competition organized by our teacher @anasuleidy. The Topic of this contest is SLC22-W3 / Human Rights (HR). So this is a very important competition where we can learn some important things. Below are some questions that I will answer correctly. So let's get started.

Part 1 - Based on what was explained in class, state in your own words and with explanations whether you consider that human rights are respected or violated in your country.

In Bangladesh, human rights are recognized under the constitution and international agreements, but in real life, human rights are violated in various cases. Such as civil and political rights, economic and social rights and sometimes discrimination against ethnic or religious minorities.

  • Respect for human rights : Human rights are recognized as a fundamental right in the constitution of Bangladesh. After the independence of Bangladesh in 1971, various international agreements and conventions related to human rights have been adopted, through which various legal measures have been taken to protect human rights.

  • Violation of human rights : But in reality, human rights violations happen in many cases in Bangladesh. Examples of violations include police torture, interference with media freedom, harassment against political opponents, disappearances, and threats to freedom of expression.

Specifically :

  • Economic and Social Rights : In many cases workers' rights are not properly protected in the workplace. Many people still live in poverty and their rights to basic amenities such as education, health and housing are not properly guaranteed.

  • Rights of religious minorities : People of different religions including Hindus, Buddhists, Christians are minorities in Bangladesh, some of their rights are not accepted many times.

From these perspectives, human rights are sometimes not properly respected in Bangladesh, although in some cases states and international organizations are helping to remedy this.

Part 1 - Please state, according to the laws of your country, whether Human Rights have the same value as the Constitution of your country, whether they are supra-constitutional, or whether the Constitution prevails over international treaties on Human Rights.

According to the laws of Bangladesh, human rights issues are clearly included in the constitution. But let us discuss how they prevail or relate to the Constitution.

The constitution of Bangladesh includes several fundamental rights related to human rights. These rights guarantee the rights of straight people to life, liberty and dignity. This includes,

Right to Life (Article 32)The right to life is recognized. It is considered as a very important right.
Freedom of expression (Article 39)Freedom of expression, freedom of media etc. are protected within the state.
Freedom of Religion (Article 41)A person can practice his religion freely.
Right to security and liberty (Article 34, 35)Torture and unlawful arrest or detention are prohibited.

These rights are clearly mentioned in the constitution and if they are violated the concerned person can take legal action in the courts of the country.

Sub-Constitutional Human Rights :

Some human rights in Bangladesh are not directly mentioned in the constitution but are included in some laws as sub-constitutional rights. For example, workers' rights, women's and children's rights, minority rights, etc. are protected through state laws and regulations, but the implementation of these rights is sometimes weak.

United Nations Universal Declaration of Human Rights : Bangladesh has signed this declaration and has tried to incorporate its basic principles into the laws of the country.

International Agreements and Conventions : Bangladesh has signed many international human rights conventions, such as the Charter on the Rights of the Child, the Charter on the Rights of Women, etc.

The constitution of Bangladesh gives precedence to international agreements and conventions in some cases, as Article 25 of the constitution states that respect for international law shall be the basis of the state's foreign policy. However, if an international agreement conflicts with a country's constitution or law, the country's law prevails

Part 2 - I mentioned any organisation in your region that has jurisdiction over human rights. In your opinion, how useful it has been and how its operation has influenced respect for human rights in your country.

The National Human Rights Commission (NHRC) is one of the organizations that work to protect human rights in Bangladesh. It is an independent organization that monitors and develops the human rights situation in Bangladesh. The function of this organization is to receive complaints of human rights violations, investigate and make recommendations to the government.

|Activities of National Human Rights Commission :

  • Prevention of Human Rights Violations : The NHRC receives public complaints about various human rights violations such as harassment, torture and illegal detention. It usually investigates cases and makes recommendations against guilty persons.

  • Protection of Rights : The Commission makes direct recommendations to the government to prevent human rights violations and protect human rights.

  • Awareness raising : The organization conducts seminars, workshops, and various campaigns to sensitize the general public about human rights.

Effects And Effects :

Functionality : The NHRC has been effective in some areas especially in receiving complaints from the people and reaching the government. It has made people aware of human rights violations and they have been able to protect their rights through this organization. However, this commission has faced limitations in some cases due to lack of legal power and lack of cooperation with government agencies.

Effects :

Extensive discussion and work on human rights has led to the protection of human rights in some cases. In particular, there have been several positive changes in the rights of women, children and minorities. However, at times the proper implementation of justice in some complaints is difficult, and in some cases the lack of government action results in the failure to prevent human rights abuses.

Prospects and Challenges :

PotentialIf the NHRC can function more independently and get support from the government, it will be able to improve the human rights situation in Bangladesh.
ChallengesThe main problem is the limited capacity of the organization and administrative barriers. It is often hampered by high-level political pressure and government weakness.
Part 2 - Have you or someone close to you been a victim of human rights violations? If so, what was the situation and were you able to assert your rights?

Reminds me of an incident that happened to a close friend of mine. A few years ago he was going out of the house one day and on the way he had an altercation with some police officers. The police intended to arrest him while standing on a busy street. They asked him to show his identity card. Despite his identity card, the police acted rough.

he knew her rights and protested calmly. he then filed a complaint with the Human Rights Commission and an investigation began within a week. Action was taken against the police officials. This experience gives him the courage to defend his rights and he understands how to seek redress when human rights are violated.

Part 3 - (Case study 1.) A woman loses her son when he dies at the hands of assailants who kill him to steal his car. The assailants are later arrested and prosecuted for the murder. He is serving the sentence provided for by law. However, the woman believes that her right to life has been violated and decides to file a complaint with the Inter-American Commission on Human Rights.
Please state whether you believe that the human rights of the victim in this case were indeed violated and whether the complaint to the aforementioned body should be admitted or not. Explain your answers.

The death of the woman's son in this case must be considered a heartbreaking incident and a violation of her right to life. As the killers are arrested and the legal process is being followed, the trauma felt by the woman or the loss of her son's life is a deep emotional loss.

Violation of human rights here usually means non-guarantee of security or right to life by the state. As the killers are being punished, there is no direct negligence or inaction by the state but the emotional distress and loss to the woman is significant.

In this case, filing a complaint with the Inter-American Commission on Human Rights may be a justified step if, according to the woman, the state or legal process has not taken sufficient measures to provide her with compensation or peace of mind. He has the right to claim his damages and justice through the Commission.

Case study 2 - A person is arrested in the middle of an anti-government protest. He is beaten by police officers, resulting in his death. The prosecutor assigned to the case begins the investigation without being able to precisely identify the perpetrators of this murder. Several years go by and the victim's relatives turn to the prosecutor's office for an answer, and are told that the case has been closed because several years have passed without being able to identify the officers who caused the death.
Please state whether you believe that the human rights of both the victim and his/her family are being violated. Explain your answers.

In this case it is clear that the human rights of the victim and his family have been violated. The fundamental responsibility of government and law enforcement agencies is to ensure the safety of citizens and maintain the rule of law. The incident of police torture and death of a person arrested during the protest is a clear example of human rights violations.

The failure of the prosecutor to identify the perpetrators and the case being closed for a long time indicate the negligence and failure of the state to ensure justice and legal rights. In such circumstances the victim's family has every right to demand a fair trial and punishment of those responsible for the murder of their child.

As the government failed to investigate and did not take any steps to get fair answers to the family members their human rights especially right to justice were violated. They should report this situation to international human rights organizations. Because it is an example of state's disregard for justice and disregard for law.


Human rights are the natural rights of people that are protected by national laws and international treaties. Human rights violations sometimes occur in Bangladesh, such as police torture or protracted legal proceedings. The duty of the state is to ensure the safety and fair trial of its citizens, which when it fails, human rights are violated. So I am very happy to answer all questions from my point of view.
