MARIJUANA: THE SETTLEMYER TRUST STORY

In the beginning, no one knew how it could be, let alone “would be” done. Las Vegas can be a pretty innovative place to live, but how do you administer legalized medicinal marijuana and for that matter, recreational marijuana?

One would think that given the nature of the sale of the formerly schedule 1 controlled substance now regarded as schedule 4 by the Federal Government, the players in this industry would be well scrutinized, investigated and vetted, but that may not be the case. And as such, there may be some inscrutable characters participating in the industry.

Take the case of the Settlemeyer Trust. It leased the property to a so called reputable Licensed Marijuana Grower only to have the Grower renege on the lease. After a grueling qualifying period and after allowing the Grower to write the terms of the lease, the grower decided to renege. And now no one seems to know if the Grower even has a license since the State refuses to divulge the licensing information without a court order. 

Originally, it was said that the vetting process for a State marijuana license was on par with that of the gaming industry. Whether or not this is true remains to be seen, but so far, it appears that the State is protecting this group and it may be due to the prevailing nature of the hands on licensees being comprised of mainly ATTORNEYS.

The Settlemeyer Trust has participated in good faith with the Grower, living up to all that was required by way of the Grower’s OWN lease terms, but now wonders if there may be fraud involved. It also appears that non adherence to the Growers own lease contract was simply an opportunity to litigate and possibly settle for less money than is called for by the lease. At this point, there are many questions as to intent of the Grower, and whether or not the Growers actions were and are malicious overtures to the future bankrupting of the industry; the industry that is barely 4 months old. Only time will tell.
