"A second change would prevent personal records of the complainant that are in the accused’s possession, such as journals or diaries, or medical records, or perhaps personal letters, as in the Ghomeshi sex-assault trial, from being used as evidence unless a judge agrees in a private hearing."

Sort:

I think I can answer some of your questions.
The canadian constitution...
Under the heading of "Guarantee of Rights and Freedoms", the section states:

“ 1. The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.

The supreme court agrees! And as such has found for instance that canadians have no right to legal council when arrested, nor personal property rights.

So long as the government, or any government agency or employee such as a police officer duely notifies you as such.

In other words, Canadians have a charter of privileges to be infringed upon at the will and whim of the government.
You can thank Justin's daddy for a constitution that protects the government from the people.

But keep hope. The constitutional right of all Canadians to have sex with adolescence children has been secured with the removal of that nasty anal sex law! (sarcasm)
