The Argentine justice ratified the embargo of funds from a Mercado Pago digital wallet account and this marked a historical precedent.

Since the beginning of this year, the AFIP included digital wallets in its list of seized accounts. There was a case that had been dismissed but this week the chamber ruled in favor of the AFIP. The justification has been that there are no legal impediments to not granting the embargo since there is NO law that declares that digital goods stored in wallets outside the banking system are unseizable and that due to the technological boom and changes, the law must be interpreted according to the circumstances.

This sentence is applicable for the moment only to virtual wallets such as Mercado Pago and Ualá, as well as to registered Argentine exchanges that provide unique keys. Because cryptocurrencies are digital assets that can be seized.

Let us remember that this can only happen, that is; You can seize those goods in which the AFIP can access the private key of the Wallet, otherwise it CANNOT. So we must be careful where we place our crypto assets, especially in Argentina.

La justicia Argentina ratificó el embargo de fondos de una cuenta de una billetera digital de Mercado Pago y esto marcó un precedente histórico.

Desde principios de este año, la AFIP incorporó en su lista de cuentas embargables las billeteras digitales. Hubo un caso que había sido desestimado pero esta semana la cámara fallo a favor de la AFIP. La justificación ha sido que no se encuentran impedimentos legal para no conceder el embargo ya que NO existe ley que declare que los bienes digitales almacenados en wallets fuera del sistema bancario sean inembargables y que debido al auge tecnológico y los cambios, se debe interpretar el derecho conforme a las circunstancias.

Esta sentencia es aplicable por el momento solo a las billeteras virtuales como Mercado Pago y Ualá, como para los exchanges Argentinos registrados que brindan claves únicas. Debido a que las criptomonedas son activos digitales que pueden ser embargables.

Recordemos que esto solamente puede suceder, es decir; se puede embargar aquellos bienes en los que la AFIP pueda acceder a la clave privada de la Wallet, de otra manera NO puede. Entonces debemos tener cuidado donde colocamos nuestros criptoactivos, sobretodo en Argentina.
