Trump Must Immediately Demand the Ballot Images for WI, MI, PA, AZ

The ballot images will detect machine-hacking fraud of astronomically unlikely state flips. Any citizen can also demand them.

Cheated Candidate Finds Way to Stump Election Fraud, by Citizens Demanding Ballot Images be Preserved

A Republican primary candidate for US Senate in Massachusetts who is suing his secretary of state for $1.2 billion after election returns in which many towns tallied more votes than voters, has stumbled upon a way to make it more difficult to steal elections.

The Massachusetts Secretary of State's office also admitted, according to the Shiva campaign court complaint, to contacting Twitter and having the candidate's quarter-million follower Twitter account suspended, one of his main means of communication with his thousands of supporters.

Using a feature of modern vote counting systems which automatically take a digital image of each ballot as it is fed into the machine, citizens can demand that these images be preserved, as federal law requires, so that the vote counts produced by the machine can be verified by citizens without touching the paper ballots.

FULL COURT COMPLAINT

The system is described in "Voting Machine Digital Ballot Images Could Let Public Recount Elections, But Many Locales Aren't Saving or Sharing This Data" at Alternet.com.

The Republican primary candidate Dr. Shiva Ayyadurai, a gadfly, anti-lockdown entrepreneur with multiple degrees in the bio-sciences from MIT, discovered that the ballot images in his race were destroyed, after he called foul upon seeing more votes than voters in many of his districts. He also noted an improbably consistent vote breakdown of 60 precent to 40 percent in districts with greatly varying demographics.

It is flatly illegal to destroy election records, including ballots, in federal races before 22 months (52 USC 20701.)

Some election departments have argued that ballot images do not constitute election records. However, in various court cases, it has been explained that, in fact, the ballot images are primary documents, because when the vote counting systems in question automatically generate the ballot image, the optical reader does not discern votes from the paper ballot. It discerns them from the ballot image. ("Making Digital Ballot Files Public Is Key to Transparency")

Over 60% of US voting jurisdictions use this type of technology.

Election integrity activists have long held that electronic vote-counting machines are easy to hack, and cause the winning candidate to lose and the losing candidate to win.

Ayyadurai, who goes simply by Dr. Shiva, denounces the current lockdowns as a power play by governments to abridge Constitutional rights. Shiva demanded the ballot images from Massachusetts Secretary of State William Galvin's office, which heads the state's election division, after he lost to a candidate recruited by the state's GOP establishment who did not campaign.

Shiva's lawsuit is asking for a judgement of $1.2 billion for harm done to US democracy.

Federal law requires all election records in federal elections to be preserved for 22 months. One organization which has been leading the fight for ballot images to be preserved universally is AuditElectionsUSA.org. The group has fought and won court battles in various states for ballot images to be preserved.

AuditElectionsUSA publishes a database of the counties and cities in the US whose voting systems use ballot imaging technology.

Ordinarily, in order to obtain a recount for a race, a candidate must undergo an uphill battle in court to force election authorities to access the paper ballots, which then require special handling and the payment of overtime to election workers properly trained in the process. But the ballot images in a race can easily be downloaded onto a flash drive or a DVD for citizens to examine and recount. Any significant anomalies discovered could then provide the basis for accessing the paper ballots.

Thus far, state election authorities are loath to allow verification of their announced results of any kind, and will always fight any lawsuit asking for paper ballots to be recounted, by hand or otherwise.

Dr. Shiva ran a strong campaign featuring hundreds of sign standouts and campaign events, and became a regular feature of the Massachusetts political landscape. Shiva built upon his first campaign against US Senator Elizabeth Warren in 2014, when he made waves with his campaign sign. Shiva, who was born to abject poverty in India but went on to MIT and became a successful entrepreneur, adopted a mocking sign with the slogan "Only a real Indian can defeat the fake Indian."

Shiva seems to frighten Massachusetts political establishment with his outspokenness and willingness to criticize both Republicans and Democrats. He calls the little-known GOP candidate who was declared the winner in the primary a "doofus."

Shiva is a mounting a write-in campaign against the Democratic nominee, US Senator Ed Markey.
