This leaves a bad taste in my mouth; but, I support the decision.

That's not to say that Smollett is any less guilty, or not an awful person. This is to say that Kim Foxx is an awful person, and it's good that she was voted out of office.

Still, while Kim Foxx was breaking the rules with a fake recuseal and the appointment of an avatar of her choosing to handle the case, Smollett was given a plea deal. Smollett took the plea deal. That means that Smollett went to court, and rather than enter a plea of not guilty, he chose no contest.

That, of course, happened before Cook County made an attempt to correct the process and hired a proper special prosecutor who pursued real charges and a real conviction.

This falls under double jeopardy.

Do not confuse yourself here -- Smollett is still guilty. The satisfaction of Smollett still having this conviction on his record is not worth fucking with double jeopardy. Double jeopardy is an important protection in the law that does much more good than harm.

The damage to Smollett's reputation is far more devastating to Smollett than that conviction.
